About this policy

This Privacy Policy describes how CREALITY 3D (HK) TECHNOLOGY LIMITED ("Creality","we","us", or "our") collects, uses, and discloses your personal data when you use the Creality Cloud platform (the "Platform"). Please read this Privacy Policy carefully to understand our practices regarding your personal data and how we will treat it.

The Privacy Policy ("Policy") applies when you purchase and/or use the following products or services:

  • Creality Cloud Websites (crealitycloud.com);

  • Creality Cloud Apps (Creality Cloud and Creality Cloud Lite);

  • Other customer-supporting services provided by Creality and/or its partners, including but not limited to customer support service ("Creality Services").

For the purpose of this Policy, the above products and services are collectively referred to as "Creality Cloud Products and Services". From time to time, we may develop new or offer additional services or products. Such new products and services will also be subject to this Policy unless otherwise stated when they are launched by us.

Please note that this Policy is a legally binding agreement between you and Creality Cloud. By using the Creality Cloud Products and Services, you acknowledge that you have read, understood, and agreed to the terms of this Policy. If you do not agree to the terms of this Policy, you must NOT use the Creality Cloud Products and Services.

1. Personal Data We Collect

We will collect and process your Personal Data solely for the purposes described in Section 2 of our Policy, and only in relation to your purchase and/or use of Creality Cloud Products and Services. Here are some examples of the Personal Data we may collect:

Personal Data provided by you:

Account Information: When you create a Creality Cloud account, known as the "Creality Cloud Account", we collect the necessary personal data to establish your account and enable you to use our Products and Services. This may include your email address, profile photo, profile name, user ID, and other information required for account verification and usage.

Contact Information: When you purchase or request products or services from Creality Cloud, we collect the necessary personal data to process your order. This may include your name, email address, order details, mobile phone number, physical address, ZIP/postal code, country, and other relevant contact information. We may use your physical address to deliver legally required notices or physical goods that you have purchased or requested.

Payment Information: When you make a payment for our products or services, we process your payment data. The specific personal data collected and used may vary depending on the payment method. This may include your name, mobile phone number, bank details, payment method type (credit or debit), card type, expiration date, and limited digits of your card number (Note: We never collect or store your full card number for security purposes). Additionally, we may retain details of your payment history or other payment-related information.

Transaction Information: When you make a purchase or request products or services from Creality Cloud, we may collect information about your purchase history or transactions facilitated by us, including details such as purchase records.

Personal Data collected when you use Creality Cloud Products and Services:

When you utilize Creality Cloud Products and Services, we collect information about your device and how you and your device interact with our products and services. This may include:

Device Information: This includes your device name/model, device serial number, or any other device identifier that can be used to identify your device. It may also include device activation time, operating system, hardware model/version, network connection, crash data, user settings (such as region and language), and other relevant device-related information.

App Information: This includes app version, software identifier, app operation logs, and app settings (such as region and language).

Usage Information: This encompasses your internet or network activity data, such as interactions with our products and services, IP addresses, printing operation data (including printer control information and printer operation information), performance data, diagnostic data, and other usage-related data.

Print Information: This may include the G-code data and configuration information, printing settings, model picture, plate thumbnails in each print job forwarded to the 3D printer in order to print successfully and display the print information of 3D Model in each client ("Printing Files") and other information related to the print job we may store, including start times, finish times, filament consumption and other relevant information when you use the print history reprint function (collectively "Other Printing Information").

3D Model Files: This may include your 3D model files (in 3D mesh or cad file), model description, model pictures, documentation files, license, model print settings and/or other 3D model related information. We will process the 3D Model Files only when you use the 3D Model community services of Creality Cloud.

Fraud and Abuse Prevention Information: Personal data that we need to collect for verification purposes to prevent fraud and abuse, including data of device trust and Appeal Records. The Appeal Records include:

- Copyright appeal information, including the identity information of the appealer, the reason and description of the appeal, and evidence of copyright ownership

- Data of the model appealed

- Information on the outcome of the appeal

2. How We Use Your Personal Data

We may use your personal data for the following purposes:

To provide and maintain the Platform: Your personal data is necessary to ensure the proper functioning of Creality Cloud's platform and to deliver the products and services you have requested. This includes account setup, authentication, and managing your preferences and settings.

To process your transactions and payments: Creality Cloud collects the necessary personal data to process your transactions and payments securely. This includes information such as your name, contact details, and payment information to facilitate the purchase of products or services.

To communicate with you and respond to your inquiries: Creality Cloud uses your personal data to communicate with you regarding your account, orders, and any inquiries or support requests you may have. This enables them to provide efficient customer service and address any concerns or questions you may have.

To personalize your experience on the Platform: Creality Cloud may use your personal data to tailor and personalize your experience on their platform. This can include providing relevant recommendations, content, and features based on your preferences and usage patterns.

To send you updates, newsletters, and promotional materials: If you have provided consent, Creality Cloud may use your contact information to send you updates, newsletters, and promotional materials about their products, services, and special offers. You can opt-out of receiving these communications at any time.

To improve products, services, and user experience: Creality Cloud analyzes and utilizes aggregated data to improve their products, services, and user experience. This may involve identifying usage patterns, troubleshooting technical issues, conducting research, and implementing enhancements based on user feedback.

To comply with legal obligations: Creality Cloud may process personal data to fulfill their legal obligations, such as complying with applicable laws, regulations, or court orders. This includes data retention, disclosure, or other legal requirements imposed on them.

3. Your Privacy Rights

As a user of our Platform, you have certain rights regarding your personal data. These rights include:

The right to be informed (Articles 13 and 14 of the General Data Protection Regulation GDPR)

Right to be Informed: You have the right to be informed about the personal data we process about you and how we process it. How to exercise this right: You will be informed about the personal data we process about you and how we process it through this Privacy Policy, the information provided to you when using Creality Cloud, or by contacting us at teamcloud@creality.com.

The right of access (Article 15 GDPR)

Right: Request access to the personal data we process about you. How to exercise this right: You can request access to and obtain a copy of your personal data processed by Creality Cloud by contacting us at teamcloud@creality.com. When you make a data access request, you will receive the information about your data that Creality Cloud is required to provide under Article 15 of the GDPR.

The right of rectification (Article 16 GDPR)

Right: You may request that we amend or update your personal data where it's inaccurate or incomplete. How to exercise this right: You can edit your account data by contacting us at teamcloud@creality.com.

The right of erasure ("Right to be Forgotten") (Article 17 GDPR)

Right: You may request us to erase certain of your personal data.

For instance, you can ask us to delete the personal data:

- That is no longer necessary for the purpose for which it was collected or processed.

- That we have processed based on your consent, provided that you have withdrawn your consent.

- That has been unlawfully processed by us (if applicable).

- That you have objected to the processing (refer to the "Objection" section in Chapter 6, "Your Privacy Rights" below).

- In other scenarios defined by law.

However, there are situations where Creality Cloud may not be able to fulfill your request to delete your personal data, including:

- When the personal data is still necessary for the purpose for which it was collected.

- When Creality Cloud's interest in using the data outweighs your interest in having it deleted (for example, when we need to process the personal data to protect our services from fraudulent activities).

- When Creality Cloud has a legal obligation to retain the relevant personal data.

- When Creality Cloud needs the personal data to establish, exercise, or defend legal claims (for example, when there is an unresolved dispute related to your account).

How to exercise this right: You can request the deletion of your personal data by contacting us at teamcloud@creality.com.

The right of restriction (Article 18 GDPR)

Right: You may request restrictions on processing your personal data in the following situations:

- When you are disputing the accuracy of the information.

- When the information has been unlawfully processed, but you oppose its deletion.

- When we no longer need your information for a specific purpose, but you require it for establishing, exercising, or defending legal claims.

- When you have objected to our processing and we are evaluating your objection request (refer to the "Right to Object" section in Chapter 6, "Your Privacy Rights" below).

You have the right to request us to temporarily or permanently stop processing your personal data.

The right of portability (Article 20 GDPR)

Right: You have the right to request a copy of your personal data in an electronic format and the right to transmit that data to another service provider, provided that we are processing your personal data based on your consent or for the performance of a contract. Creality Cloud will make reasonable efforts to fulfill your request.

The right to object (Article 21 GDPR)

Right: You may object to the processing of your personal data by Creality Cloud in certain circumstances. This right applies when we are carrying out a task in the public interest, pursuing our legitimate interests or those of a third party, or when you object to the processing of your personal data for direct marketing purposes.

How to exercise this right: You can utilize the controls provided on the Creality Cloud platform to disable or customize certain features that process your personal data. For information on how to control tailored advertising, please refer to the end of this section. Alternatively, you can contact us at teamcloud@creality.com to exercise your right to object.

The right not to be subject to automated decision making (Article 22 GDPR)

Right: You have the right to not be subject to a decision based solely on automated decision-making (decisions made without human involvement), including profiling, if that decision would have a legal or similarly significant effect on you.

How to exercise this right: As of now, Creality Cloud does not employ this type of automated decision-making when providing Creality Cloud Products and Services. Therefore, your right in this regard is already respected. If you have any concerns or questions, please contact us at teamcloud@creality.com.

The right to withdraw consent (Article 7 GDPR)

Right: You have the right to withdraw your consent for the processing of your personal data by Creality Cloud. This right applies when Creality Cloud is processing your personal data based on your consent.

How to exercise this right: You can modify the relevant control settings on the Creality Cloud platform to withdraw your consent, or you can contact us at teamcloud@creality.com for assistance in exercising your right to withdraw consent.

4. Sharing Your Personal Data

We may share your personal data with third parties in the following circumstances:

- With your consent or at your direction

- With service providers who assist us in operating the Platform and providing our services

- With business partners and affiliates for joint marketing purposes (if you have provided consent)

- In response to legal requests or to comply with applicable laws and regulations

- To protect our rights, property, or safety, or the rights, property, or safety of others.

5. Data Retention

We will retain your personal data for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. We will also retain and use your personal data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

6. Data Security

We take appropriate measures to protect your personal data from unauthorized access, alteration, disclosure, or destruction. However, please note that no method of transmission over the internet or electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.

7. Transfer to Other Countries

Due to the global nature of our business, Creality Cloud may share personal data internationally with Creality Cloud affiliated companies, subcontractors, and partners when conducting the data processing activities described in this Policy.

When transferring personal data internationally, we ensure that the data transfer complies with applicable laws. We also take measures to guarantee an adequate level of data protection when transferring your information outside of the EEA, the UK, or Switzerland. These measures include:

1. Adequacy Decisions: We transfer personal data to countries outside the European Economic Area ("EEA") that have sufficient laws to protect personal data, as determined by the European Commission under Article 45 of the GDPR (or equivalent decisions under other laws). For example, we may transfer the personal data described in Chapter 1 (Personal Data We Collect) to vendors based in Japan and the Republic of Korea.

2. Standard Contractual Clauses ("SCCs"): The European Commission has approved contractual clauses under Article 46 of the GDPR that allow companies in the EEA to transfer data outside the EEA to countries without an adequacy decision. These clauses, known as SCCs, ensure the protection of personal data. For example, we utilize SCCs to transfer the personal data described in Chapter 1 (Personal Data We Collect) to our data hosting provider located in the US. You can exercise your rights under the Standard Contractual Clauses by contacting us at teamcloud@creality.com.

8. Children

The Creality Cloud Platform is not intended for use by children under the age of 13. We do not knowingly collect personal data from children under 13. If we become aware that we have collected personal data from a child under 13 without parental consent, we will take steps to delete such information. If you believe that we may have collected personal data from a child under 13, please contact us using the information provided in Section 9.

9. Changes to this Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable laws. We will notify you of any material changes by posting the updated Privacy Policy on the Platform. Please review this Privacy Policy periodically for any updates. Your continued use of the Platform after the posting of changes will constitute your acceptance of those changes.
